MADDE 49. – (1) Süreli hapis cezası, kanunda aksi belirtilmeyen hâllerde bir aydan az, yirmi yıldan fazla olamaz.
(2) Hükmedilen bir yıl veya daha az süreli hapis cezası, kısa süreli hapis cezasıdır.
